  2. The present website, www.seatraveller.gr, (hereinafter referred to as the “website”) is the website of SEA TRAVELLER P.C. (hereinafter referred to as the "Company") -with registered office in Kos, Marmari, postcode 85300, TIN (ΑΦΜ) 801754880, Tax Office of Kos- and at the same time the e-shop for the provision of its services.

    Sea Traveller is a boat rental and travel experience company, based in Kos, that aims to offer you the holiday of your dreams. Through our homonymous website we introduce ourselves, present our services, inform you on related issues, allow you to contact us in various ways to have your questions answered and benefit from our services, as well as to check the availability of our boats and proceed to booking directly through the website.

    Accessing, using and browsing the website is free and does not impose any financial obligations on the visitors / users. The services provided by the Company through this website are covered exclusively by these Terms of Use and the Terms and Conditions of Service, which form an integral part of these Terms of Use, and any other terms and conditions are expressly excluded. Any visitor / user who visits the website or transacts through the website shall be deemed to consent to and unconditionally accept the terms set forth herein, without exception, and understand that these terms constitute a legally binding agreement between the visitors / users and the Company.

    If you do not agree with these terms, as well as with the Privacy Policy -which is an integral part of these Terms of Use-, you must refrain from using the website and its services. The Company reserves the right to change the Terms of Use at any time. The visitors / users should periodically check the terms to keep themselves informed of their content and are solely responsible for staying up to date.

    These terms apply to both those who just visit the website and those who interact with the website in any way (hereinafter referred to as the "users", "user").

    The users who proceed to booking through our e-shop must, in addition, carefully read and agree to our Terms and Conditions of Service, before booking.

    You do not need to provide any personally identifiable information to use the website. Personal data of yours will only be requested if you wish to contact us via our contact form or otherwise or you subscribe to our newsletter or use our e-shop.

    The user is responsible for accessing the services of the website and such access may require the payment of fees to third parties (e.g. internet service providers).   3. Right of Withdrawal

The consumer's right to unjustified withdrawal within 14 calendar days with a refund, in case you book our services through our e-shop or, in general, from a distance, does not apply for the services we provide (article 3ib of Law 2251/1994). The terms and conditions of cancellation are set out in our Terms and Conditions of Service in the Cancellation Policy section.

  5. Disclaimer / Limitation of Liability

Given the nature and volume of the Internet, the Company is not liable, under any circumstances, including negligence, for any form of damage suffered by the user of the pages, services, options and contents of the website. The contents of the website are provided "as is" without any guarantee, expressed or implied in any way. To the fullest extent permitted by law, the Company disclaims all warranties, expressed or implied, including but not limited to those implying merchantability and appropriacy for any particular purpose.

    The Company carefully controls the level of security of the services it offers in the digital environment, using programs against the spreading of viruses and malware. It is recommended that the users use software to protect themselves against computer viruses, Trojan horses, time bombs, etc, while browsing the website. The Company does not exercise any kind of correction or intervention in the data transmitted by the users. The users are required to fill in correctly and accurately the fields of name, surname, telephone, e-mail, message in the online contact form, the fields in the booking form, as well as the data requested in each case to enable us to provide our services. The use of the website is subject to the Greek, European and international laws and the user agrees not to use the website in violation of these laws. In the context of the above, the users agree and assume the responsibility not to use the website for:

    1. sending, publishing or otherwise transmitting any content that is illegal for any reason, causes unlawful injury or damage to the Company or any third party, or violates the confidentiality or privacy of any person's information,
    2. sending, publishing or otherwise transmitting any content that offends the accepted principles of morality, social values, minors, etc,
    3. sending, publishing or otherwise transmitting any content which they do not have the right to transmit under the law or applicable contracts (such as inside information, proprietary and confidential information acquired or disclosed as part of employment relationships or covered by confidentiality agreements),
    4. sending, publishing or otherwise transmitting any content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of third parties,
    5. sending, publishing or otherwise transmitting any material that contains software viruses or any other codes, files or programs designed to damage, destroy or disrupt the operation of any software or computer hardware,
    6. intentionally or unintentionally violating applicable laws and harassing third parties in any way,
    7. collecting or storing personal data of other users.

    The users assume responsibility for any damage caused to the Company by improper or unauthorized use of the website.

    In addition, the users understand and agree that the partners, the administration, the employees, the members and the associates of the Company are not liable for anything arising from third parties using the website.

    Any use contrary to the above will result in the termination of the provision of our services without notice, in addition to any legal penalties.

The present website, www.seatraveller.gr , is also independently protected as an original work of visual design and applied arts, according to the specific provisions of the law, as well as a collection of works (Article 2, Law 2121/1993) and constitutes intellectual property of the Company.

    Any copying, analog / digital recording and mechanical reproduction, distribution, transfer, downloading or creation of derivative works based on this content or misleading the public about the actual provider of the website is prohibited. Reproduction, dissemination, transmission, retransmission of the material or any other use of the content in any manner or means for commercial or other purposes is only permitted with the prior written consent of the Company or any other holder of the intellectual property rights.

    If any right under this Agreement is not exercised by the Company, it shall not be deemed to be a waiver and the right may be exercised at any time by the Company at its sole discretion.

    In case of conflict between the Greek and the English version of this Agreement, the provisions of the Greek version shall prevail.
