  1. Introduction
  2. The present website, www.seatraveller.gr, (hereinafter referred to as the “website”) is the website of SEA TRAVELLER P.C. (hereinafter referred to as the "Company") -with registered office in Kos, Marmari, postcode 85300, TIN (ΑΦΜ) 801754880, Tax Office of Kos- and at the same time the e-shop for the provision of its services.

    Sea Traveller is a boat rental and travel experience company, based in Kos, that aims to offer you the holiday of your dreams. Through our homonymous website we introduce ourselves, present our services, inform you on related issues, allow you to contact us in various ways to have your questions answered and benefit from our services, as well as to check the availability of our boats and proceed to booking directly through the website.

    The services provided by the Company through this website are covered exclusively by the Terms of Use and the accompanying Terms and Conditions of Service, which are an integral part of the Terms of Use, and any other terms and conditions are expressly excluded.

    Any customer who proceeds to the order of our services shall be deemed to consent to and unconditionally accept the terms set forth herein, without exception, and understand that the terms constitute a legally binding agreement between you and the Company.

    In case you do not agree with these terms and / or the Privacy Policy -which is an integral part of these Terms and Conditions of Service-, you must refrain from using our e-shop and the Company's services in general. The Company reserves the right to change these terms at any time. The users of the website should periodically check the terms and conditions in order to keep up to date with their content and are solely responsible for this.

    The following terms apply in particular to the users of the website who book a boat / order the Company's services and are supplementary and specific to the general Terms of Use, which apply to all the users of the website.

  3. Booking procedure
  4. Any interested party may book a boat either through the website or by sending an e-mail or through instant messaging applications used by the Company or by telephone. In any case, and regardless of the means chosen, the client will be asked to provide us with his / her full details, exact dates of pick-up and delivery of the boat, place of pick-up and delivery, choice of boat, number of passengers, choice of booking with or without a skipper, speedboat operator licence number, if required, and any other request he / she may have. Upon submission of the necessary information, the client shall receive a message confirming the receipt of his request.

    In order to complete the booking of a boat, the client must pay 50% of the total amount of the fare in advance. The remaining 50% shall be paid upon pick-up of the boat.

    For the purposes of filling the Agreement – Rental Certificate, the client will need to send us or present upon pick-up of the boat the following absolutely necessary documents:

    • A copy of both sides of their identity card;
    • A copy of the speedboat operator licence (if required);
    • Information for the issuance of payment vouchers.

  5. Means of payment
  6. All payments can be made in cash, by credit / debit card, PayPal or deposit to the Company's bank accounts.

    Keep in mind that in case you book a boat online through our website and pay by card, the card details will not be stored in the Company's storage media during the transaction, but they will be directly registered in a secure environment offered by our partner that has undertaken the routing of the cards (Viva payments).

  7. Security deposit
  8. The renter shall pay a security deposit of five hundred Euros (500 €), cash or by credit card. This will be refunded at the end of the rental period and the final inspection upon return of the boat. The fee will be used to cover any damage to the boat, if any.

  9. Weather Conditions
  10. The rental and sailing of the boat shall be carried out normally when the wind intensity at the pick-up point does not exceed 4 Beaufort and the port authorities allow it.

    In the event of adverse weather conditions on the day of the commencement of the rental, the Company shall propose to the client an alternative route. If there is no alternative route or the weather conditions prohibit sailing, an alternative day and time of rental shall be proposed to the client, if he / she so wishes and there is availability. If rescheduling the rental is not possible, the deposit and the security shall be returned to the client.

  11. Departure
  12. One day before departure we must be informed of the desired time of departure of the boat, according to the client's schedule.

    Upon arrival at the predetermined pick-up point, the client will be asked to sign all the necessary documents for the rental of the boat, as well as to settle any outstanding payments.

    Upon pick-up of the boat, the Company gives the client a detailed demonstration of the boat and its equipment and the client is asked to sign a declaration of acceptance of the boat and a list of the equipment it carries. Moreover, there is a detailed briefing on safety procedures and information on the use of the boat, as well as the use of the documents / licences given to you. For the client’s convenience, the boat is delivered by the Company with full fuel tanks.

    The above mentioned procedure can be carried out at our head office on any previous day, upon request of the client, in order to expedite the departure on the day of the commencement of the rental.

  13. Return
  14. The boat shall be returned to the point of delivery at the prearranged time. Upon delivery, the Company shall check the condition of the boat and its equipment. The refuelling of the boat shall be carried out by the Company. The cost of fuel shall be borne solely by the client.

  15. Insurance - Disclaimer of liability
  16. All our boats are covered by private insurance for the risks of third-party liability for death, bodily injury, property damage and pollution up to the amount stated in the insurance policy. The client is aware of the content of the insurance policy and, in the event that he / she causes damage exceeding the amount covered, then the client shall be solely responsible for the payment of the excess amount.

    The Company shall not be liable for any loss or damage to the customer's property during the rental period.

    Any mechanical or other damage caused by the client to the boat during the rental, as well as any loss of part or all of the equipment on board, shall be borne entirely by the client.

  17. Renter's obligations
  18. The renter - operator is obliged:

    • To inspect the boat before departure and accept it unconditionally, if it satisfies him / her, and, in case of damage, to report it to the Company.
    • To deliver the boat in the condition in which it was received.
    • To return the boat before sunset. Early return of the boat does not entitle the client to claim a refund.
    • Not to allow any of the persons on board, during the rental period, to operate the boat.
    • To ensure that the maximum distance of the boat from the shore does not exceed 2 NM.
    • To comply with the safety and navigation regulations.
    • Not to use the boat for any use not specified by the manufacturer.
    • Not to use the boat in any of the following ways:
      • In any kind of race or contest;
      • For any illegal purpose or in an illegal manner;
      • For the carriage of any type of dangerous or explosive substances;
      • To push and / or tow any other watercraft, tubes or water toys;
      • After dusk or during the night;
      • To carry loads in excess of the stated capacity;
      • In a reckless, abusive or negligent manner;
      • In a reckless, abusive or negligent manner;
      • In breach of the terms and conditions of this agreement in any way;
      • Outside the approved area of use.

    Under no circumstances may the customer sublease the boat to another natural or legal person. The client's rights under this agreement are non-transferable.

    In case the rental of the boat is approved due to fraud or misrepresentation, or the boat is used for an illegal purpose or in breach of these terms in any way, all rights to the use of the boat shall be revoked and any subsequent use of the boat would be without the Company's permission. In any such case, the Company has the right to immediately repossess the boat, retain all fees and rental charges and charge the client for any damage to the boat.

  19. Documents - Special legislation
  20. Each boat is delivered to the client in perfect condition, meeting the safety conditions laid down by law and provided with the necessary safety certificates and documents in full force and effect.

    Every rental boat is provided with a licence to operate as a professional boat (blue in colour and not green, as the one carried by recreational boats) and is equipped with the equipment and utilities prescribed for a recreational boat.

    The licence of the rental boat shall contain the reference “RENTAL BOAT UNDER THE PROVISIONS OF ARTICLE 38 OF THE GENERAL PORT REGULATION” in red ink.

    • The Company shall provide each client upon rental and shall take back at the end of the rental the following :
      1. The original Sailing Licence;
      2. A copy of the insurance policy;
      3. A copy of the Certificate for the fulfillment of the legal requirements for the rental of motorboats and / or speedboats;
      4. Copies of the General Port Regulations (G.P.R.) Nos. 20 and 23, as in force, regulating the field of motorboats and speedboats, the G.P.R. No. 38, as in force, regulating the rental of motorboats and small speedboats, and the International Regulations for Preventing Collisions at Sea.

    During the period of rental and depending on the type of the boat, the client must also carry on board the boat operator licence to be shown to the Port Authorities, if requested.

  21. Rental with a skipper
  22. The Company offers the possibility of renting a boat with a skipper - operator. In this case, the Company's skipper is responsible for the piloting and operation of the boat, assumes all the duties and responsibilities of the operator and takes care of all the needs of the boat (handling, mooring, cleaning, fuel and all the necessary formalities).

  23. Prices - Coverage
  24. The cost of rental depends on the boat chosen and the time during which the rental takes place.

    The prices are in Euro (€) and include the rental of the boat, VAT and other taxes, the insurance, all the necessary rescue and firefighting equipment and supplies, according to the Greek legislation and depending on the type of the boat, and the equipment described for each boat.

    In case the client prefers a different point of delivery and / or pick-up of the boat from the one designated by the Company, there is an additional charge.

    The prices listed on the website or in our forms are indicative. The Company reserves the right to adjust prices according to the circumstances. More passengers and / or luggage, as well as a change of route, may result in an increase in the cost and therefore an increase in the final price for the provision of our services.

    Prices do not include the skipper's fee, intermediate port fees and charges and the cost of fuel. The boat is delivered to the client full of fuel and the client pays the Company the fuel price upon return of the boat, based on the consumption made.

  25. Cancellation Policy
  26. In case of cancellation of the booking by the client for any reason, the deposit will be refunded to the client only for cancellations made more than 30 days before the requested rental date.

    The deposit is non - refundable for bookings confirmed less than 30 days before the rental date. The client may, however, request a transfer of the rental to another date on which the boat will be available up to 15 days before the originally agreed rental date.

    In the event that a deposit has been paid for the booking of a boat and the client does not arrive after 1 (one) hour from the agreed time of pick-up of the boat, the Company has the right to assign the boat to another interested party. The booking shall not be postponed to another day and time and the deposit shall not be refunded.

  27. Other terms
    • The passenger limit depends on the type of boat chosen.
    • Boats and engines are checked by the Company before each delivery.
    • An operator licence is not required to rent a boat with horsepower of less than 30 hp.
    • The minimum age of the renter-operator is 18 years old. The operator must be able to perform all the handlings necessary for the safe operation of a boat. The Company reserves the right to refuse the rental, if it is found that the operator lacks the relevant competence.
    • The consumption of alcohol and drugs by the operator of the boat is prohibited. The Company will not allow anyone who is considered to be under the influence of alcohol or drugs to pick-up the boat. In this case, any deposit shall not be refunded.
    • All passengers get on board at their own risk and must avoid any actions or behaviour, on board or at sea, that endanger themselves or others.
    • The Company recommends that persons with serious health problems, women in advanced pregnancy or persons in any other condition which may be aggravated by the use of the boat should avoid boarding. The Company reserves the right not to allow such persons to board the boat for their own safety.
    • If conditions so require (e.g. weather), the Company reserves the right to postpone or cancel the sailing for safety reasons. In the event that the postponement of the sailing to another date is not possible (e.g. due to the client's departure), any deposit shall be refunded to the client.

  28. Personal Data Protection
  29. The protection of our clients' personal data is very important to us. For more information on how we collect and process your personal data, please read carefully our Privacy Policy, which constitutes an integral part of these terms.

  30. Applicable Law
  31. The above Terms and Conditions of Service, as well as any modification thereof, shall be governed by the Greek law. For any dispute that may arise from this Agreement and which cannot be resolved out of court, the competent courts of Kos shall have jurisdiction.

  32. Final provisions
  33. If any provision of these terms and conditions is or becomes invalid, unenforceable or non-binding you will still be bound by all other provisions.

    If any right under this Agreement is not exercised by the Company, it shall not be deemed to be a waiver and the right may be exercised at any time by the Company at its sole discretion.

    In case of conflict between the Greek and the English version of this Agreement, the provisions of the Greek version shall prevail.
